1. PURPOSE OF THIS DOCUMENT

These General Terms and Conditions of Sale (hereinafter "General Conditions") govern the sale to final consumers (hereinafter "Clients" or "Client") of women's clothing items and related accessories marketed by LA BOTTEGA DI BRUNELLA DI MANDARA MARIA ROSARIA & C. S.N.C. (hereinafter "Bottega di Brunella") through the dedicated area of the website https://labottegadibrunella.it (hereinafter the "Website") following the procedures indicated therein.

The sale of Products between Bottega di Brunella and Clients will be governed by these General Conditions. Products can be marketed through the Italian version of the site only within Italy. For the purposes of these General Conditions, "final consumer" means any natural person acting for purposes unrelated to any business, commercial, craft, or professional activity.

2. HOW THE CONTRACT IS CONCLUDED

The information and details contained in the e-commerce reserved area of the Website should not be considered as offers: they simply constitute an invitation addressed to Clients to conclude business through the submission of purchase proposals.

The purchase proposal of the Products is formulated by the Clients at the time of submitting the electronic order form, which they must fill out and confirm on the order summary screen. If Clients wish to receive an invoice, they must select the appropriate option in the order form. It is also possible for the Client to specify a shipping address different from the one provided in their personal data. Once the order form has been definitively sent, an order summary page is displayed, and a confirmation email is sent to acknowledge receipt of the order.

By submitting the order form, the Client agrees that the possible purchase contract will be governed by these General Conditions. Therefore, all orders are subject to acceptance by Bottega di Brunella, which reserves the right to not proceed with any order proposal in the following cases:

  • The data provided by the Client during the order form completion are incomplete or incorrect;

  • The Client is not qualified as a final consumer or does not meet the requirements for payment conditions;

  • The ordered Products are not available. In this case, Bottega di Brunella will not be held responsible for variations in the availability of certain Products. If only part of the ordered Products is unavailable and no other causes justify the rejection of the order proposal, Bottega di Brunella will proceed with the order proposal limited to the available Products.

In the cases mentioned above, Bottega di Brunella will inform the Client via email that the order proposal has not been accepted (in whole or in part) and, therefore, the contract is not concluded. In such a case, Bottega di Brunella will refund any amounts already paid by the Client.

3. PRICES AND PAYMENT CONDITIONS

3.1. The sale prices of the Products, shipping costs, and payment methods are those indicated on the Website and are expressed in Euros. The sale prices of the Products include VAT but do not include shipping costs, which will be added to the total amount due. Bottega di Brunella reserves the right to change the prices listed on the Website at any time. Bottega di Brunella cannot be held responsible for any price changes.

3.2. The Client agrees to pay the price of the Products purchased as follows:

  • Credit Card Online: Payment with Visa, Mastercard, Maestro credit cards. Credit card payments are managed directly by Shopify Payments, which guarantees secure online transactions using SSL 128-bit encryption protocols.

  • PayPal: The charge will be made upon confirmation of order receipt. In case of non-acceptance of the order proposal, the amount will be refunded to the Client.

  • Klarna: Payment through Klarna allows for installment payments in 3 (three) interest-free installments. The first payment will be charged when the order is shipped from the warehouse, the second after 30 days, and the third after 60 days from the shipping date.

  • Gift Card: The amount due will be deducted from the balance on the Gift Card upon confirmation of the order receipt.

4. PRODUCT SHIPPING METHODS

4.1. Products will be delivered based on the times and methods specified in the delivery service chosen by the Client. The shipping costs for home delivery are borne by the Client and may vary according to the selected delivery service. Upon shipment, Bottega di Brunella will send the Client a shipment confirmation email with tracking information.

5. RIGHT OF WITHDRAWAL

The Client has the right to withdraw without penalty and without specifying the reason within 14 calendar days from the receipt of the purchased Products.

The withdrawal can be exercised by sending an explicit declaration of withdrawal to Bottega di Brunella.

6. REFUND TIMES AND METHODS

Bottega di Brunella will process the refund as soon as possible and within 30 days from the date it became aware of the Client's exercise of the right of withdrawal.

7. PRODUCTS

The Products displayed on the Website are original items of the “Bottega di Brunella” brand.

9. APPLICABLE LAW AND DISPUTE RESOLUTION

The General Conditions of Sale are governed by Italian law.
